Electronic Communications & E-Signature Consent

Consent to electronic delivery
Baysart MMC (the "provider") is a digital-only service, and all documents are provided electronically. By tapping "I agree", you consent to receive agreements, disclosures, statements and notices in electronic form rather than on paper.
This consent covers, among others: user agreements and their updates, legal and risk disclosures, transaction confirmations and account statements, price, fee and limit notices, and any other notices required by law or sent by the provider.
The provider may deliver these electronic communications through the following channels:
- In-app notifications, screens and document sections
- The email address you provided at sign-up
- Push notifications sent to your mobile device
Electronic signature
Tapping "I agree" in the app, confirming with biometrics (Face ID / Touch ID or fingerprint) or entering your PIN, and signing with the private key on your device constitute your electronic signature. These actions have the same legal effect as your handwritten signature and are binding on you.
By taking these actions, you confirm that you accept the relevant agreement or disclosure and that you authorize the transaction you are confirming. A transaction signed with your private key is treated as authorized by you.
You are responsible for protecting your device's biometric and PIN confirmation and your private key. A signature made through these means is treated as valid and made on your behalf.
Recordkeeping
The provider keeps records of your consents and acceptances so that the agreement can be proven. These records include which version of which document you accepted and when the acceptance occurred.
The records kept may include, for example, the name and version number of the accepted document, the date and time stamp of acceptance, the confirmation method used, and the relevant signature data for transactions.
These records serve as evidence of your electronic consent and signature and are retained for the period required by applicable law.
Withdrawing consent
You may withdraw your consent to electronic delivery at any time. To withdraw consent, contact the provider at [email protected] or reach support through https://baysart.com.
Because the service is digital-only and relies entirely on electronic communication, if you withdraw consent to electronic delivery the provider may be unable to continue providing the digital service to you. In that case your account may be restricted or closed.
Withdrawing consent does not affect the validity of documents delivered electronically or transactions signed before the withdrawal takes effect.
System requirements
To receive, view and retain electronic communications, you need the following:
- A compatible mobile device capable of running the app (with a supported operating-system version)
- The current (latest) version of the app
- An internet connection
- An active email address and enabled notification permissions to receive push notifications
- The ability to read, download or save email or in-app documents
